How
the Author Agency Agreement Works
The
author agency agreement is relatively simple and straightforward. After we
decide to work together, we'll send you our agency agreement to you for your
signature.
Here
are the highlights of the agreement:
We
Represent Your Interests
We
consult with you throughout the selling and negotiating process to make sure you
understand and agree with our strategies. We're working for you and your
interests. We agree to send you all correspondence and keep you informed of
anything relating to your books. Nothing is agreed to without your consent. In
fact, only your signature can execute a contract.
Exclusive
Book Representation Relationship
In
order for us to do our best work, it's very important that we make a serious
commitment to you, and that you make a serious commitment to us. If we have the
same goals and interests, we'll be able to do a better job for you.
After
you sign up, you'll be working with an entire team of agents who will work to
bring various opportunities to you. We will encourage you to be selective, and
to only choose the opportunities that make the most sense for your career.
By
working together to evaluate the opportunities that have come to you
while evaluating the opportunities that we found for you, we'll be in a position
to map out a strong plan to advance your career.
However,
if you're pursuing opportunities on your own while we are busy pursuing
opportunities for you, we'll effectively be competing with your efforts. This
diminishes our negotiating strength and reduces our ability to add value to your
career.
If
you have pre-existing relationships with publishers on specific books, or for
columns, or a particular employer, we will work with you to exclude existing
commitments from the exclusive agreement.
Agency
Clause
Our
agreement requires that you insert an agency clause into your agreements with
book publishers. This clause basically states that:
1. You've
permanently appointed Studio B to be your exclusive agent on the book, and any
extensions to the project, including revisions, extensions, and derivative
works.
2. The
publisher pays the agent on behalf of the author. The agent receives the
payment, deducts the 15% agency commission, and promptly sends you the money.
No
Additional Costs to You
Other
than the agency fee, we do not charge you a penny for phone calls, copying
costs, or any other normal overhead costs. If we don't sell your project, you
have no obligation.
Termination
The
contract lets either party terminate the agreement at any time. However, for
projects that we are in the process of representing for you, or for projects
that we have sold for you in the past, the relationship will continue and Studio
B will serve as your exclusive agent--even for revisions or extensions of
contracts that we've signed with you. However, for future projects where we have
not been involved in any way, you'll be free and clear to pursue contracts on
your own.
